Sarkozy Worried About The Internet 'Stealing Audience Share' From 'Regulated' TV Services

Earlier this week Techdirt reported on the surprisingly forthright statements of Neelie Kroes concerning the failure of the copyright system in the digital world. She made her remarks at the Forum d'Avignon in France, which was about "strengthening the links between culture and the economy".

Broadcasters Ask Brazilian Government To Protect Them From Interesting Foreign Content On The Web

Last week Techdirt wrote about a draft of a civil rights-based framework for the Internet that is being considered by lawmakers in Brazil. It seems like the Brazilian Radio and Television Association didn't get around to reading it, because they want the government there to "regulate" foreign web content flowing into the country (Brazilian news report):

Project Canvas Will be *Linux* Based

I've been pretty sceptical - and critical - of the BBC's TV over IP efforts, including Project Canvas:

Project Canvas is a proposed partnership between Arqiva, the BBC, BT, C4, Channel Five, ITV and Talk Talk to build an open internet-connected TV platform, subject to BBC Trust approval.

The partners intend to form a venture to promote the platform to consumers and the content, service and developer community.

Like the UK's current free-to-air brands Freeview and Freesat - a consumer brand (not canvas) will be created, and licensed to device manufacturers, and internet service providers owners who meet the specifications.

‘Canvas compliant’ devices (eg set-top boxes), built to a common technical standard, would provide seamless access to a range of third-party services through a common, simple, user experience.

That's despite - or maybe even *because* - it proclaims itself as "open":

A technology project to build an open, internet-connected TV platform

As well as a lack of standards in the internet-connected TV market, there is no open platform. This creates two main problems:

* The UK's current free to air TV platforms Freeview and Freesat have been unable to evolve and keep pace with technical innovation in the consumer electronics industry. While some internet services are emerging on some commercially-owned/ pay-TV platforms - these platforms are working to their own (proprietary) closed standards. A fragmented market is emerging, which could put internet-connected TV out of the reach of consumers who don't want to subscribe to pay-TV.
* The internet services need to have a commercial relationship with the TV platform to obtain a route to the shared screen. This, combined with a fragmented market of varying standards, is slowing the development of internet-connected TV services.

Project Canvas intends to build, run and promote a platform that solves both problems: providing an upgrade for free-to-air TV, and an open platform of scale that will bring a wide range of internet services to the shared screen.

We all know how debased the term "open" has become, so frankly I expected the worst when the technical details were released. Looks like I was wrong [.pdf]:

Linux has been selected as the Operating System for the Device.

Linux has been ported to run on a large number of silicon products, and is currently supported by the vast majority of hardware and software vendors in the connected television ecosystem. Porting to new hardware is a relatively simple due to the architecture of the kernel and the features that it supports. The Linux environment provides the following functionality as a basis for the development and operation of the Device software:

• Multi-processing.
• Real-time constraints and priority-based scheduling.
• Dynamic memory management.
• A robust security model.
• A mature and full-featured IP stack.

Linux is deployed on millions of PCs and consumer electronics devices, and the skills to develop and optimise for it are common in the industry. In addition, a wide range of open source products have been developed for, or ported to Linux.

It's pretty amazing to read this panegyric to Linux: it shows just how far Linux has come, and how it is taking over the embedded world.

Even though content will be "protected" - from you, the user, that is - which means the platform can't really be regarded as totally open, the Project Canvas designers and managers still deserve kudos for opting for Linux, and for publicly extolling its virtues in this way.

Update: I haven't really made clear why that's a good thing, so here are some thoughts.

Obviously, this is not a pure free software project: it's a walled garden with DRM. But there are still advantages for open source.

For example, assuming this project doesn't crash and burn, I expect it will influence similar moves elsewhere in the world, which may be encouraged to use Linux too. Even if that doesn't happen, its use by Project Canvas will increase the profile of Linux, and also the demand for people who are skilled in this area (thus probably helping to drive up salaries of Linux coders.) More generally, the Linux ecosystem will grow as a result of this choice, even if there are non-free elements higher up the stack. Correspondingly, non-free solutions will lose market share and developer mind-share.

And finally, having Linux at the heart of the Project Canvas project will surely make it easier to root...

Spot the Disconnect

On the one hand, we have a bunch of people I've never heard of whingeing in the Times:


We are very concerned that the successes of the creative industries in the UK are being undermined by the illegal online file-sharing of film and TV content. At a time when so many jobs are being lost in the wider economy, it is especially important that this issue be taken seriously by the Government and that it devotes the resources necessary to enforce the law.

In 2007, an estimated 98 million illegal downloads and streams of films took place in the UK, while it is believed that more than six million people illegally file-share regularly. In relation to illegal downloads of TV programmes, the UK is the world leader, with up to 25 per cent of all online TV piracy taking place in the UK. Popular shows are downloaded illegally hundreds of thousands of times per episode.

On the other, we have this perceptive comment from TorrentFreak:

when just this year it was reported that UK commercial TV broadcasters “enjoyed a bumper April with the highest viewing figures in five years”, that total TV viewing was up 10% year-on-year, and “the valuable yet hard-to-reach 16 to 24-year-old demographic [i.e the typical file-sharer] watched 4.9% more commercial TV in April year-on-year and saw 12% more ads,” you have to wonder exactly what the problem is.

So how do we reconcile those? Well, could it be, dear Times whingers, that the Internet actually *drives* traffic to your precious films and TV programmes, whatever they are? Could it be that the Internet is actually going to keep you all employed and so fraffly well-paid?

YouTube: A Video Commons?

I've noticed increasingly that the "young people" seem to watch YouTube rather than that old-fashioned thing called "TV". Here's a nice piece in the Guardian reminding us that YouTube is much more than a super MTV (what's that?), but is fast turning into a kind of visual Wikipedia: if somebody was able to digitise it, you can probably find it.

YouTube is best known for its offbeat videos that become viral sensations. But among its millions of clips is a treasure trove of rare and fascinating arts footage, lovingly posted by fans.

Being able to regard YouTube as a video commons: just one more reason to get rid of 18th-century copyright laws.

Open Hardware: Soon to be Boring

The New York Times has a feature on the Neuros OSD (for open source device):

The Neuros OSD connects to your TV or home theater system and allows you to archive all of your DVD and video content.

Plug the Neuros OSD into your TV, connect your DVD Player or VCR, and hit play. Your movie will be safely and legally transferred into a digital library! It works with home movies too. Just plug your video camera into the OSD, push play, and your memories are digitized.

With the Neuros OSD, you can store hundreds of hours of video in one location (like an external hard drive), get rid of those bulky cases, put an end to DVD damage, and instantly access any of your videos with the push of a button on a remote. You can even transfer your video content to a portable device (video iPod, PSP, mobile phone, etc.) to watch on the go, or email your home movies to friends and family.

It runs GNU/Linux (of course) and Samba, but also features hackable hardware, as detailed on the company's wiki (where else?).

What's remarkable about all this is not so much that a company should be adopting openness in both hardware and software (though that's good), but that it should be pointing out the fact that it is doing so, and that the New York Times picked it up. That open meme is certainly spreading.

The Death of TV?

Well, not quite, alas, but certainly an interesting shift:

We think we know that the professional news media, especially newspapers, are obsolete, that the future is all about (excuse the expression) you—media created by amateurs. But such PowerPoint distillation tends to overlook the fact that mainstream media are not all simply shriveling and dying but in some instances actually evolving. And in evolution, there are always fascinating transitional iterations along the way. Such as newspapers’ suddenly proliferating forays into online video. (And now magazines: Time Inc. just announced a new “studio” to develop Web video.)

Whereas the YouTube paradigm is amateurs doing interesting things with cameras, the newspapers’ Web videos are professional journalists operating like amateurs in the best old-fashioned sense.

What seems to be happening here is that blogs are eating newspapers' lunch, so the newspapers are eating TV's lunch. Sounds fair to me. (Via PaidContent.)

In the mass media environment, there was a general culture of "I saw it in print, therefore it must be true." This culture led to a relative atrophy of critical faculties, and made the public sphere highly manipulable, or simply prone to error. It is not, for example, that well-trained media critics could not point out the dozens of ways in which any given news report or television program were biased or incomplete. They could. But the readers, viewers, and listeners by and large adopted a trusting relationship to their media. We long spoke about the need to teach critical television watching. But that never happened, really. I think as a new generation grows up reading things that never have a clear voice of authority, that have only provisional status as inputs, we will begin to see a more critical, investigative form of reading, as well as listening and viewing. The act of reading will be more like an act of investigation, as one picks up pieces of evidence with variable levels of credibility, triangulates them, and arrives at a conclusion that continues, nonetheless, to be revisable and falsifiable. This is the essence of the scientific method. It is high time that people adopt it more broadly. I embrace this uncertainty, for with it comes critical reading. This trend is then strengthened by the widespread practices of cultural production, what I have characterized as the re-emergence of a new folk culture in the digital environment. People who create know how to be more critical users.

Sinking Venice

Those pair of old Skypers, Niklas Zennstrom and Janus Friis, are at it again. But curmudgeon that I am, I won't be sad if this particular Venice sinks without trace:

While the software turns your PC screen into something that looks a lot like your TV, the capabilities go far beyond anything you'll experience in your den. Jiggle your computer mouse, and a variety of tools appear along the edges of the screen, even as the video continues to play. At the bottom of the screen, there are controls like those on a DVD player, including stop, pause, and fast-forward, as well as a search window to find new videos. An image on the left includes a menu of preset channels. And on the right, there's a set of interactive tools that let you share video playlists with friends or family. An image at the top of the screen identifies the channel and the name of the clip you're watching. All of the images can be expanded by clicking on them with a mouse.

Turn my marvellously metempsychotic, and perfectly protean PC into a tarted-up tub of a TV? No, grazie. (Via IP Democracy.)

Now in Pre-Production: Free Software

I wouldn't normally write about software designed for the world of film and TV industries, but this seems pretty noteworthy. Celtx (pronounced "keltix") provides

the film, TV, theatre, and new media industries with an Internet compliant tool for writing, managing and producing media content.

The film and TV industries traditionally use large binders filled with paper and taped-in Polaroid pictures to manage the production of movies and television shows. "It is incredible how little attention has been paid to the pre-production end of the business.", Celtx co-founder and company CEO Mark Kennedy stated. "Lots of time and effort have been spent introducing digital technologies to the production and post-production phases - digital cameras, digital film and sound editing, CGI software - but nothing to help those working in pre-production. Celtx is the first application to do so.

It is, of course, open source (or I wouldn't be writing about it), and is apparently based on Firefox, which is pretty amazing given the complexity of the program that has been developed as a result. It is also cross-platform and available in many localised versions. It comes from a company located in Newfoundland, about which I know nothing other than that they have laudably outrageous ambitions.

What might seem an incredibly specialised piece of code is, I think, of broader significance, for several reasons. First, it shows how the open source approach of building on what has been done before - Firefox in this case - allows even small companies to produce complex and exciting software without needing to make huge upfront investments other than that of their own ingenuity.

It also demonstrates how far free software has moved beyond both basic infrastructural programs like Linux and Apache and mainstream apps like Firefox and OpenOffice.org. As such, Celtx is a perfect example of what might be called third-generation open source - and definitely a story worth following closely. (Via NewsForge.)

Dumb, Dumber, Dumbest: Doing Down the Net

I've not read the article (which is hidden behind a paywall), but judging by this choice quotation

video will become the dominant way people experience the Internet over the next five years

we seem to have a prime example of either (a) somebody who really doesn't get it or (b) somebody with a vested interest who hopes that this dangerous new-fangled Net thing that risks making people do rash things like thinking and deciding for themselves will just settle down to the nice, safe, dumb TV whose effects we have come to know and love.

Splog in a Box?

A long time ago, in a galaxy far away - well, in California, about 1994 - O'Reilly came out with something called "Internet in a Box". This wasn't quite the entire global interconnect of all networks in a handy cardboard container, but rather a kind of starter kit for Web newbies - and bear in mind that in those days, the only person who was not a newbie was Tim (not O'Reilly, the other one).

Two components of O'Reilly's Internet in a Box were particularly innovative. One was Spry Mosaic, a commercial version of the early graphical Web browser Mosaic that arguably began the process of turning the Web into a mass medium. Mosaic had two important offspring: Netscape Navigator, created by some of the original Mosaic team, and its nemesis, Internet Explorer. In fact, if you choose the "About Internet Explorer" option on the Help menu of any version of Microsoft's browser, you will see to this day the surprising words:

Based on NCSA Mosaic. NCSA Mosaic(TM); was developed at the National Center for Supercomputing Applications at the University of Illinois at Urbana-Champaign.
Distributed under a licensing agreement with Spyglass, Inc.

So much for Bill Gates inventing the Internet....

The other novel component of "Internet in a Box" was the Global Network Navigator. This was practically the first commercial Web site, and certainly the first portal: it was actually launched before Mosaic 1.0, in August 1993. Unfortunately, this pioneering site was later sold to AOL, where it sank without trace (as most pioneers do when they are sold to AOL: anybody remember the amazing Internet search company WAIS? No, I thought not.)

Given this weight of history, it seems rather fitting that something called Boxxet should be announced at the O’Reilly Emerging Technology Conference, currently running in San Diego. New Scientist has the details:

A new tool offers to create websites on any subject, allowing web surfers to sit back, relax and watch a virtual space automatically fill up with relevant news stories, blog posts, maps and photos.

The website asks its users to come up with any subject they are interested in, such as a TV show, sports team or news topic, and to submit links to their five favourite news articles, blogs or photos on that subject. Working only from this data, the site then automatically creates a webpage on that topic, known as a Boxxet. The name derives from “box set”, which refers to a complete set CDs or DVDs from the same band or TV show.

As this indicates, Boxxet is a kind of instant blog - just add favourite links and water. It seems the perfect solution for a world where people are so crushed by ennui that most bloggers can't even be bothered posting for more than a few weeks. Luckily, that's what we have technology for: to spare us all those tiresome activities like posting to blogs, walking to the shops or changing television channels by getting up and doing it manually.

It's certainly a clever idea. But I just can't see myself going for this Blog in a Box approach. Perhaps I over-rate the specialness of my merely human blogging powers; perhaps I just need to wait until the Singularity arrives in a few years time, and computers are able to produce trans-humanly perfect blogs.

What I can see - alas - are several million spammers rubbing their hands with glee at the thought of a completely automatic way of generating spurious, self-updating blogs. Not so much Blog in a Box as Splog in a Box.

VIIV, DRM, and Fair Use: the Big One

The ever-acute Doc Searls reports on the CES keynote from Intel CEO Paul Otellini. Given Searls' position as an alpha blogger, it was inevitable that this was a live, minute-by-minute blog - and yes, it did include the obligatory moan about the missing WiFi connection.

But what is really important about this posting is that it makes plain VIIV's role as the platform that broadcasters and music companies - with indispensable help from a willing Intel and Microsoft - will use in their latest attempt to take complete control of content.

I already knew in 2000 that all this was coming. I knew because Eben Moglen, the legal brains behind the free software movement, and an extremely wise, articulate and modest man, told me so when I was writing Rebel Code:

Let's think of the Net for a change as a collection of pipes and switches, rather than thinking of it as a thing or a space.

There's a lot of data moving through those pipes, and the switches determine who gets which data, and how much they have to pay for it downstream. And of course those switches are by and large what we think of as digital computers.

The basic media company theory at the opening of the twenty-first century is to create a leak-proof pipe all the way from production studio to eyeball and eardrum. The switch that most threatens that pipe is the one that at the end. If the switch closest to your eyeball and eardrum is under your complete technical control, the whole rest of the aqueduct can be as leak-proof as you like, and it won't do them any good. And the switch is under your control, of course, if the software is free software.

So for the great VIIV plan to work, free software has to be shut out from the equation. This means no DVDs, no DRM for GNU/Linux - for the simple reason that truly free software always gives you the possibility of evading the software controls that are in place.

And for those of you who say, well, provided we have our traditional fair use rights, what's the problem? - this is the problem. Draft US legislation would effectively freeze your rights to existing technologies: had this been the case in the past, you would not have fair rights to burn MP3s from your CDs, or even videotape TV programmes.

There is no halfway house in this coming war, no compromise position: either you hand carte blanche to the film and music industries to decide what you can do with the content you buy, or else you fight for the right to decide yourself.

This is the Big One.

Closing the Web

For a long time, I have had two great Web hates: pages made up of PDFs and those using Flash animations. I realise now that to these I have to add a third, and for the same reason: they all undermine the openness and transparency that underlie the Web's enormous power.

I hate PDFs because they are opaque compared to Web pages. With the latter, you can see the underlying code and get at (in programming terms) individual elements of the page. This is important if you want to do clever Web 2.0-y things with content, such as mixing and matching (and mashing).

I hate Flash animations even more: they are not only opaque - there is no cyber-there there - they are barriers to my free navigation of the Web and waste my time as they download. In effect, they turn the Web into television.

To these, I must now add TinyURLs. In themselves, they are a great idea: too many Internet addresses have become long snaking strings of apparently random text. But the solution - to replace this with a unique but shorter URL beginning http://tinyurl.com commits the sin of obscuring the address, an essential component of the open Web.

So while I applaud TinyURL's rigorous terms of use, I never follow any TinyURLs in my Web wanderings, however easy and seductive they might be. For all I know, they might well be taking me straight to a PDF or Flash animation.
