Solving Microsoft's Hard Problem

Microsoft has a problem to solve. On the one hand, open source is not going away – its distributed, modular and iterative approach clearly has many advantages compared to traditional top-down development techniques when it comes to writing and maintaining complex code. On the other hand, Microsoft has spent over a decade propagating variegated FUD against it (although it's true that it has adopted a more accommodating stance in recent years, what with the release of odd bits of code under open source licences, and various attempts to snuggle up to some open source projects).

Still, Microsoft's basic stance remains the same: free software is OK for certain, limited situations, but for serious, enterprise-y stuff you need honest-to-goodness closed source. Given that, how can it begin to tap into the power of open source for its major projects without seeming to admit it got it all wrong, and that open source is actually a better approach?

This has led to many interesting attempts to translate that success into different fields, notably content (with things like Wikipedia) and data (the whole open data movement currently spreading through enlightened governments around the world.)

Taking Openness to the Next Level

Yesterday I wrote about one particular issue with standards: the fact that the associated patent licensing (if applicable) can shut out free software completely. But it's clear that the problems go much deeper: the entire standards-making process is conducted in a way that is often the antithesis of openness. That's not just bad for free software, it also means that the standards themselves suffer, as do many potential participants who are unable to contribute as fully as they otherwise might. Here's an interesting attempt to rectify many of those problems by drawing on the manifest success of the open source approach:

Realising the Dream of Open Source Hardware

The growing success of open source software has naturally spurred on others to apply its lessons elsewhere. Open content is perhaps the most famous translation, notably through the widely-used Creative Commons licences. But one of the most challenging domains to come up with something equivalent to the Open Source Definition (OSD) is hardware – not surprisingly, perhaps, since hardware is analogue, not digital, and hence very different in nature.

From Open Source to Open Hardware

This column mainly talks about open source software, for the simple reason that code dominates the world of openness. But open source hardware does exist, albeit in a very early, rudimentary form. Last Friday, I went along to NESTA for what was billed as an “Open Hardware Camp”. Fortunately, I didn't see any tents, since that's not really my kind of thing; what I did see was a huge amount of enthusiasm, and some interesting hints of things to come...

The Great Digital Bait and Switch

One of the (many) things that get my goat about ACTA is the sheer dishonesty of the project. It was originally put forward as aiming to curb large-scale counterfeiting - hence its name, Anti-Counterfeiting Trade Agreement.

It was sold as only going for the "big fish", with promises that ordinary people wouldn't be inconvenienced. In fact, it was purely for their benefit, its proponents explained, since one of the most heinous kinds of counterfeiting it attempts to tackle is counterfeit drugs - an undeniable health hazard.

But then something strange happened. Counterfeiting morphed into copyright infringement, and yet all the legal heavy guns aimed at massive, criminal counterfeiting remain, now ranged against little you and me.

What's interesting is that there's clearly a collateral campaign underway to support ACTA by hammering on the wickedness of counterfeiting - allowing the bait and switch game to be played again. Here's an example:

Canada trails far behind the United States, United Kingdom, Japan and France by not enacting tougher laws and penalties for selling imported bogus goods, an anti-counterfietting conference heard yesterday.

Lorne Lipkus, of the Canadian Anti-Counterfeiting Network, said a private members' bill will soon lobby Parliament for expanded copyright laws, seizure rights similar to those that block suspected fake goods entering the U.S., plus heavier sentences for convicted sellers and importers.

The Toronto lawyer and conference organizer estimated Canadian manufacturers lose $20 to $30 billion and thousands of jobs to cheaper knockoffs.

We are warned against "knock-offs": counterfeit goods are clearly knock-offs, but so, in the minds of the media cartel, are unauthorised copies of copyright material. The difference between counterfeit and copyright has been subtly elided. As a result, the solution demanded for this large-scale counterfeiting of goods - clearly *physical* goods - is "expanded copyright law".

Nor is this the only underhand attack. Here's a very poor article in the Wall Street Journal:

The palm-sized Arduino serves as an electronic brain running everything from high schoolers' robots to high-end art installations. But perhaps the oddest thing about the device is the business model behind it.

Plans for the Arduino, a simple microcontroller board, are available online, and anybody may legally use them to build and sell knockoffs.

This, in some ways, is even worse. It's equating the ability to *build* on the work of others, and improve upon it, as another kind of "knock-off". This is not just wrong-headed, but really pernicious, because it implies that open source is little better than counterfeiting.

The Church of Openness

In Digital Code of Life, I explained at length - some would say at excessive length - how the Human Genome Project was a key early demonstration of the transformative power of openness. Here's one of the key initiators of that project, George Church, who wants to open up genomics even more. Why? Because:

Exponentials don't just happen. In Church's work, they proceed from two axioms. The first is automation, the idea that by automating human tasks, letting a computer or a machine replicate a manual process, technology becomes faster, easier to use, and more popular. The second is openness, the notion that sharing technologies by distributing them as widely as possible with minimal restrictions on use encourages both the adoption and the impact of a technology.

And Church believes in openness so much, he's even applying to his sequencer:

In the past three years, more companies have joined the marketplace with their own instruments, all of them driving toward the same goal: speeding up the process of sequencing DNA and cutting the cost. Most of the second-generation machines are priced at around $500,000. This spring, Church's lab undercut them all with the Polonator G.007 — offered at the low, low price of $150,000. The instrument, designed and fine-tuned by Church and his team, is manufactured and sold by Danaher, an $11 billion scientific-equipment company. The Polonator is already sequencing DNA from the first 10 PGP volunteers. What's more, both the software and hardware in the Polonator are open source. In other words, any competitor is free to buy a Polonator for $150,000 and copy it. The result, Church hopes, will be akin to how IBM's open-architecture approach in the early '80s fueled the PC revolution.

A New Dawn

Well, not quite, but here's another of those open source, open hardware thingies:


aurora is a usb powered multichannel mixer in a typical dj form factor. the device features two linear channel faders, a single a/b crossfader and eight backlit buttons. twenty four backlit knobs allow you to control effects. aurora, unlike most midi controllers, enhances performances with controllable ambient lighting.

Open Hardware is...Hard

The Economist does one of its periodic "what's going on in that wacky world of open source" pieces, mercifully not as fundamentally flawed as earlier ones. This is about open hardware (OpenMoko, Chumby, Bug Labs, RepRap), and why it's, er, hard:

In addition to publishing all the software code for a device, for example, makers of open-source hardware generally reveal the physical information needed to build a device, including schematics, materials and dimensions. This is not something manufacturers normally do, and takes time and effort. Supplying open-source hardware is necessarily, therefore, more time-consuming and complex. “It can’t be as simple as open-source software,” says Peter Semmelhack, the founder of Bug Labs, a company based in New York that sells open-source hardware modules to put into other devices. “It has chips, schematics and things coming from many sources.” And suppliers of those many parts are not always interested in going open source, which further complicates matters. OpenMoko tries to use chips with open specifications, says Mr Moss-Pultz, though some chipmakers are reluctant to play along. “It’s like they’re taking their pants off in public,” he says.

Open Hardware: Soon to be Boring

The New York Times has a feature on the Neuros OSD (for open source device):

The Neuros OSD connects to your TV or home theater system and allows you to archive all of your DVD and video content.

Plug the Neuros OSD into your TV, connect your DVD Player or VCR, and hit play. Your movie will be safely and legally transferred into a digital library! It works with home movies too. Just plug your video camera into the OSD, push play, and your memories are digitized.

With the Neuros OSD, you can store hundreds of hours of video in one location (like an external hard drive), get rid of those bulky cases, put an end to DVD damage, and instantly access any of your videos with the push of a button on a remote. You can even transfer your video content to a portable device (video iPod, PSP, mobile phone, etc.) to watch on the go, or email your home movies to friends and family.

It runs GNU/Linux (of course) and Samba, but also features hackable hardware, as detailed on the company's wiki (where else?).

What's remarkable about all this is not so much that a company should be adopting openness in both hardware and software (though that's good), but that it should be pointing out the fact that it is doing so, and that the New York Times picked it up. That open meme is certainly spreading.

Open Hardware Licence

Many hardware designers wish to engage in collaborative development, just as Open Source programmers do today. The proliferation of programmable gate array devices and cheap circuit board prototyping are making this easier. One organization of hardware designers, TAPR, has produced and successfully manufactured innovative digital communications hardware designs since the 1980's, when they pioneered the first practical peer-to-peer wireless networking device.

This license will be deployed on a new wave of Open Source hardware. It is designed to be similar enough to Open Source Software licenses to be certifable under the Open Source Definition / Debian Free Software Guidelines, the generally-accepted definition of Open Source licensing, which I created in 1998.
